Jay Vyas Almost all attorneys now discourage travel to India unless emergency situation. For H1B stamping there is a great deal of uncertainty. My colleagues got 221G and it took 3 months to clear after DHS people came to office verifying LCA and job duties. Not sure about OPT extension rules. Do you require any form of stamping? If no and if you have valid entry visa till future expiry then should be good to travel. Check with DSO or immigration attorney for an hourly fee.

What are the options available for my daughter (Age 5) whose L2 to H4 COS was denied . Can she get stamping from Canada ?
My Daughter was on dependent L2 Visa based on my L1 Visa (5 years Max out period April 2018) . Since my wife is on H1B till May 2021, we filed a COS for my daughter from L2 to H4 in February 2018 prior to L1B max out , which was denied today (11/13/18) . I am currently in Canada on a work permit while my spouse and daughter are in USA . I can get my daughter stamped in Canada if possible. 1) Can my daughter (minor, Age 5) apply for stamping in Canada given she is out of status .
2) Does she qualify for Dropbox processing in Canada
3) Does she need to travel to home country to get stamped.
4) Does she face a 3 year ban for overstaying > 180 days
5) What is the best option to take from here

Given my limited knowledge, I would suggest your daughter immediately travel back to India to avoid any accrued illegal stay. This should be your very first step now and try to travel within this weekend since her I 94 has expired and out of status. After that you could try applying a fresh H4 stamping from India and it should take max of 30 days. Try to explain the illegal stay in DS-160 form and have a good rapport during actual stamping. COS is now being denied almost universally without any logic. As usual, check on an Immigration attorney ASAP.

No new update. It’s stilling a sinking ship and they may propose by Dec end or By Jan 15th. Most probably by Jan due to holiday mood. Main thing to watch here is if they are proposing removing EAD from existing applicants which may be possible and very cruel thing to do. EAD is 100% a goner for new applications after they pass the regulations 6 months from Jan 2019. This comment period is a sham and we know they are going to remove it. Courts can block it via lawsuits but eventually it will be heard at Supreme Court and will fail there due to 5-4 majority of Republican favouring judges.
